Patent Practice in Türkiye

A Turkish patent file has more procedural room than many applicants expect.

Patent prosecution in Türkiye is not merely a sequence of filing, search, examination and renewal deadlines. The system contains procedural levers that can recover a missed step, change the route of protection, accelerate an early technical opinion, preserve a second claim strategy, or keep a granted right alive after an annuity failure.

We use those levers with four questions in mind: What can still be recovered? What can be accelerated? What can be changed? And what should be preserved before the next procedural door closes?

Applicant view
A missed date is not always a lost right — and a pending application is not always locked into one procedural route.

Recovery

Missed a deadline?

The application may still be recoverable.

Article 107 of Industrial Property Code No. 6769 provides a continuation-of-proceedings mechanism for many missed time limits relating to a patent application. If the statutory conditions are met, the applicant may request continuation within two months from notification of the consequence of the missed time limit, together with the prescribed fee and the omitted act.

  • Continuation is not universal: the Code excludes certain periods, including the annuity compensation period and the priority period.
  • Where the loss occurred despite the care required by the circumstances, restoration of rights may provide a separate route, subject to a two-month period from removal of the cause and an absolute one-year limit from expiry of the missed period.
  • Restoration can affect third-party positions: a good-faith user who began using the invention during the period of loss may retain a limited right of continued use.

Missed an annuity — even after the surcharge period?

There may still be a statutory route back.

An annuity that is not paid on the normal due date may be paid with a surcharge during the following six months. If that period is also missed, the patent right terminates retroactively as of the annuity due date — but the Code provides a further compensation window after the termination notice.

  • Payment of the compensation fee within two months from notification can revive the patent from the date of payment.
  • The termination notice must itself be issued within the statutory one-year period starting from the missed due date.
  • Revival does not erase intervening rights acquired by third parties. Recovery therefore solves the registry problem, but may not fully restore the enforcement landscape.
Time

Want protection to start working earlier?

Publication timing is itself a strategic decision.

A Turkish patent application is normally published at eighteen months from filing or priority, but the applicant may request earlier publication. Publication triggers provisional protection, while the Code also recognises protection before publication where the alleged infringer has been informed of the application and its scope.

  • Early publication can support an earlier enforcement posture.
  • But publication also changes what can be done with the application: an unpublished application that is withdrawn, deemed withdrawn or refused may in principle be refiled for the same invention; once the application has been published and withdrawn, that reset route is no longer available.
  • Speed should therefore be chosen for a commercial reason, not as an automatic default.

Search report changed the case?

The application is still a drafting opportunity.

A Turkish patent application may be amended while proceedings before TÜRKPATENT continue, provided the amendment does not extend beyond the content of the application as filed. That allows prosecution to be managed proactively rather than waiting for every limitation to be demanded by the examiner.

  • A search-stage objection that prevents a search from being drawn up can be answered with argument and/or amendments within the statutory response period.
  • The search report is therefore a strategic checkpoint: claims can be aligned with the strongest disclosed position before substantive examination develops.
  • The same original-disclosure discipline that matters before the EPO remains central: the possibility to amend is only as good as the support created on filing.
Route

How many examination rounds are there?

Prosecution is deliberately finite.

After the examination request, TÜRKPATENT may invite observations and amendments where the application is not considered compliant. Those substantive notifications may be repeated, but the Code limits them to a maximum of three.

  • Each examination communication therefore consumes part of a finite procedural runway.
  • A response should not merely postpone the problem; it should decide what deserves argument, what deserves amendment and what fallback scope must remain available.
  • Where grant is possible only after a final amendment, the Code provides a separate two-month period to make the required amendment.

Need a second claim strategy?

A voluntary divisional does not require a unity objection.

The Code permits divisional applications not only when lack of unity is raised, but also voluntarily at the applicant’s request, while the parent application remains pending and within the content originally disclosed.

  • The divisional retains the filing date of the original application and, where applicable, its priority.
  • Past annuities associated with the divisional must be dealt with when the divisional is filed.
  • This makes the divisional route useful for commercially distinct embodiments, competitor-facing claims or a claim architecture that should not be forced into the parent case.
Route

Patent no longer the right vehicle?

The protection route can still change.

A pending patent application can be converted into a utility model application. Conversely, a utility model application may be converted into a patent application within the prescribed period following notification of the search report.

  • The Regulation places a latest point on patent-to-utility-model conversion: no later than expiry of the response period to the last examination notification.
  • Priority is preserved on an accepted conversion.
  • Conversion is not an endless toggle: a converted application cannot be converted back again.

Improved the invention after filing?

Türkiye still has an add-on patent route.

The Code retains the institution of an add-on patent for an improvement or development that remains in unity with the subject matter of a pending main patent application. The add-on application may be filed until publication of the decision to grant the main patent.

  • The main application is not treated as prior art against the add-on for inventive-step assessment under the statutory rule.
  • No separate annuities are payable for the add-on application or add-on patent while it retains that status.
  • The add-on can be converted into an independent patent application, and statutory conversion rules also protect it if the main case disappears in certain circumstances.

Grant obtained?

The prosecution story may not be over.

Türkiye provides a six-month post-grant opposition period starting from publication of the decision to grant. Grounds include lack of patentability, insufficient disclosure and added subject matter.

  • The patent proprietor may file observations and amendments during opposition.
  • TÜRKPATENT may maintain the patent as granted, maintain it in amended form or revoke it.
  • A grant strategy should therefore anticipate not only allowance, but also the claim set that can survive the first six months after grant.

Not using the patent?

The principal risk is compulsory licensing, not automatic cancellation.

The patented invention is subject to a use obligation. The relevant period is the later of three years from publication of the grant decision and four years from the application date. Market conditions and circumstances outside the proprietor’s control are relevant to the assessment.

  • The Regulation recognises objective licensing, standard-compliance and other technical, economic or legal obstacles outside the proprietor’s control as potential justified reasons for non-use.
  • A declaration that the patent is being used or cannot be used is filed with TÜRKPATENT within the relevant period, recorded in the register and published.
  • Failure to make use, make serious and genuine preparations, or meet national market demand can expose the patent to a compulsory-licence request once the statutory period has expired.

Assignment or licence completed?

Recordal is not mere housekeeping.

Assignments, licences and other transactions affecting a Turkish patent application or patent take effect against good-faith third parties from registration. Patent rights that are not properly recorded may not be asserted against such third parties.

  • Recordal should therefore be part of transaction closing, not a later administrative afterthought.
  • The same applies when a patent portfolio is transferred as part of financing, acquisition or group restructuring.
  • A proprietor asserting patent protection must also identify the relevant application or patent number.

A Turkish patent file should be managed, not merely docketed.

The most valuable procedural move is often small: a continuation request made in time, an annuity recovered after the ordinary grace period, an early search before a commercial decision, a divisional filed before the parent closes, or a conversion chosen before the available route disappears.

We treat Turkish patent prosecution as the management of those choices — not simply the administration of deadlines.
